We use the information you provide for purposes including, but not limited to: Responding to your inquiries and processing rental bookings, communicating via phone, SMS, or email about reservations, alerts, and updates, sending promotional communications if you’ve opted in (with the ability to opt out at any time), enhancing our website performance and customer experience, conducting internal analytics and service improvements

Our online forms may include optional opt-in choices for:

RENTAL AGREEMENT & LIABILITY WAIVER

By making a reservation or operating a rental vessel (“watercraft”), you agree to the following legally-binding conditions contained in the “Agreement” (“Waiver”, “Liability Release”, “Rental Agreement”, “Liability Waiver”) below.

GENERAL REQUIREMENTS & ELIGIBILITY

  • Arrive 30 minutes early with the credit card used for reservation and a valid driver’s license or photo ID.
  • Renter (LESSEE) must be at least 21 years old with a valid driver’s license.
  • A valid Texas Boater Education Certificate is required if born after August 31, 1993.

It is the responsibility of the LESSEE to obtain the proper certification. Failure to present valid photo ID and proof of valid Boater Safety Certification will result in no rental, no refund, and no rescheduling.

Rental time starts at the time reserved. Please arrive no less than 30 minutes prior to your reservation time to complete paperwork and renter orientation. Time lost due to late arrival or early returns will not result in a refund or Rental Credit.

SAFETY & OPERATION

  • Swimming is at your own risk. No lifeguard on duty.
  • US Coast Guard approved personal flotation devices (Like Jackets, PFDs) are required at all times while on the water, including tubing or using any water accessories.
  • Passenger capacity will not exceed limits set by Next Wave Boat Rentals. Each person counts as a passenger, regardless of age, height, weight, ability, etc. Maximum allowed passengers set by Next Wave Boat Rentals. LESSEE further agrees that the vessel will not exceed the maximum passenger capacity and weight limitations as posted in the vessel.
  • All activities are prohibited after sunset.
  • Alcohol/drug use while operating any vessel is prohibited.
  • Renter agrees to operate safely and follow all applicable laws.

CANCELLATIONS & NO-SHOWS

  • All reservations are non-refundable unless Trip Protection is purchased at the time of reservation booking.
  • With Trip Protection: LESSEE may cancel up to 24 hours in advance for full rental credit.
  • Without Trip Protection: no refund, credit credit, or rescheduling for any reason.
  • No-Shows: Failing to appear for your rental reservation at the reserved date and time will result in forfeiture of reservation and all payments.
  • Arriving 1 hour or more after the reservation start time is considered a No-Show, and reservation is forfeited without compensation, rental credit, or refund. 

WEATHER & CREDIT POLICY

  • Next Wave Boat Rentals reserves the right to cancel this agreement due to inclement or impending weather, equipment issue, unforeseen circumstance, act of God, and/or for other reasons outside of Next Wave Boat Rentals’s control. In such an event, a rental credit can be issued, per Next Wave Boat Rentals’s discretion.
  • No refunds, compensation, or rental credit will be issued for negative or unfavorable weather conditions.
  • Rental Credit can be offered for reservation cancellations due to dangerous weather conditions (i.e., rain, high winds, lightning, temperature extremes, tornado warnings, etc.) that may cause harm or damage to the LESSEE, guests, or vessels. Next Wave Boat Rentals will not offer a Rental Credit if conditions are merely “not-ideal” or “uncomfortable”, including, but limited to overcast skies, light rain, temperature or other conditions subject to the discretion of Next Wave Boat Rentals. Rental Credits are never offered in advance.
  • Rental Credit is not guaranteed and offered at the sole discretion of Next Wave Boat Rentals via digital gift card redeemable only on the Next Wave Boat Rental website and will expire 365 days following the issue date. Rental Credit is non-transferrable, is not redeemable for cash, and can only be redeemed by the original person to which it was issued.
  • Rental Credit is only issued by the Next Wave Boat Rentals representative on location on the date and time of your scheduled reservation. Any cancellation fees or additional charges issued by other parties or vendors as result of cancelled/postponed reservation by Next Wave Boat Rentals is the sole responsibility of the LESSEE not Next Wave Boat Rentals or agents/representatives of Next Wave Boat Rentals. 
  • Rental Credit issued due to cancelled reservation must be used at the location of your original reservation. Rental Credit not transferable to another other location or lake which we serve or may serve in the future. This policy applies to all of our boats, vessels, watercraft, etc.

VESSEL SUBSTITUTIONS & CONDITIONS

  • Next Wave Boat Rentals reserves the right to substitute a comparable vessel for any reason including but limited to mechanical issues, late-returning customers. 
  • Rental availability depends on prior return and circumstances beyond our control.
  • Next Wave Boat Rentals does not guarantee vessel make, model, year, color, or condition of rental inventory. Promotional images are representative only; actual rental vessel may differ.
  • Next Wave Boat Rentals reserves the right to move customer reservations to another boat/personal watercraft for any reason without notice or compensation.

DAMAGES, RETURN, AND FUEL POLICY

  • LESSEE agrees to assume all responsibility for damages caused by the LESSEE and/or guests of the LESSEE. LESSEE is responsible for the entirety of the cost of damages. The damages cost amount will be determined at the discretion of Next Wave Boat Rentals or the owner of the damaged property. LESSEE is responsible for ALL damages not present at check-out.
  • DAMAGE DEPOSIT: A valid credit card shall be retained and will be used to provide full compensation for the facility to return said rental in as good condition as when received. Compensation includes, but is not limited to, reimbursement of articles damaged, missing or broken. Next Wave Boat Rentals is authorized to charge the credit card on file for items in such cases. In the alternative, or in addition to the charges to my credit card, Next Wave Boat Rentals, in its sole discretion, may demand that LESSEE pay such charges in immediately available funds such as cash or certified check. The amount available on the balance of the credit card shall in no way be considered a limitation on the amount of damages, reimbursements or rental charges owed to Next Wave Boat Rentals. LESSEE hereby acknowledges and understand that the watercraft is without damages or defects including, but not limited to, dents, scratches, tears, stains and propeller damage. An inspection of the watercraft will be conducted by both parties prior to the start of the reservation whereby any existing damage will be noted and acknowledged in writing on the inspection form. Upon return of the vessel, Next Wave Boat Rentals will conduct a final inspection. LESSEE will be held responsible and liable for the total cost of any and all damages to the vessel that were not noted during the initial inspection. Next Wave Boat Rentals has up to 48 hours after the rental & prior to being rented again to discover and inform LESSEE of damage found.
  • Fuel is NOT included in our rental vessel costs, unless otherwise specified at the time of reservation booking. LESSEE will fill fuel tank to “Full” at the end of the reservation at their own expense. Fuel is to be  purchased at Sapphire Bay Marina’s Ship Store at their established price. Failure to refuel will result in a 35% fuel surcharge at the expense of the LESSEE
  • Late returns: LESSEE agrees to pay late fees in the event the watercraft is not returned at the specified rental completion time. Late fees will be calculated at the rate of $100 for every 30 minutes past the specified rental completion time.
  • Rescue fee: LESSEE agrees to pay $500 rescue fee for any rescue unrelated to watercraft manufacturer defect or mechanical failure.
  • Sales and local taxes are subject to change. You will be assessed the sales tax that is in effect at the time of your event departure date, regardless of when your reservation was made.

ASSUMPTION OF RISK, WAIVER OF LIABILITY & INDEMNIFICATION

Assumption of Risk and Voluntary Participation

The undersigned (LESSEE) acknowledges that the operation or use of a watercraft involves inherent risks that may lead to bodily injury or death. These risks include, but are not limited to: sprains, torn muscles or ligaments; fractures; eye injuries; cuts, abrasions, or contusions; dehydration; drowning; exposure; head, neck, or spinal injuries; bites, stings, or allergic reactions; shock, paralysis, and death. Certain risks cannot be eliminated without destroying the unique character of boating and watersport activities.

LESSEE confirms they are physically and mentally capable of operating the watercraft, are not under the influence of drugs or alcohol, and have no health restrictions that would prevent safe participation. Participation is entirely voluntary, and LESSEE understands they are free to refuse any activity they feel is unsafe or uncomfortable.

LESSEE agrees that they are operating and using the equipment provided by Next Wave Boat Rentals at their own risk and assume full responsibility for any injury, illness, damage, or loss—both known and unknown—suffered by themselves, their guests, or any minor children in their care. LESSEE elects to participate despite the risks and agrees to waive any right of subrogation against Next Wave Boat Rentals, its employees, and agents.

Waiver and Release of Liability

By executing this agreement, LESSEE agrees that Next Wave Boat Rentals, TDSKWC LLC, and all affiliated owners, employees, agents, representatives, successors, insurers, and assigns shall not be liable for any damages, injuries, deaths, or losses arising from or related to the rental, operation, or use of any watercraft, accessories, or equipment provided.

This waiver specifically includes:

  • Any injuries sustained by the LESSEE, operators, passengers, or minor children under their custody, care, or control;
  • Any loss or theft of personal property, whether on or off the vessel;
  • Any act, omission, or negligence on the part of Next Wave Boat Rentals or related parties, whether present at the time of signing or occurring in the future.

LESSEE understands that this Liability Waiver applies even in cases of negligence, gross negligence, or fault on the part of Next Wave Boat Rentals, TDSKWC LLC, or any related party.

Indemnification of Next Wave Boat Rentals and Third-Party Liability

LESSEE agrees to indemnify, hold harmless, and defend Next Wave Boat Rentals, TDSKWC LLC, and all affiliated agents, officers, employees, or representatives from any and all claims, damages, losses, and expenses (including attorney’s fees) arising out of or relating to:

  • Use, operation, or possession of the rented watercraft;
  • Any negligent, grossly negligent, or intentional act or omission by LESSEE or their guests;
  • Any personal injury or property damage caused to third parties, including passengers of other watercraft;
  • Any injuries or property loss to members of LESSEE’s party, including but not limited to minor children;
  • Any violation of this agreement or costs incurred in its enforcement, including collection of damages, unpaid fees, or legal actions required to regain possession of the watercraft.

LESSEE agrees that jurisdiction for any legal disputes shall be the State of Texas, with venue in Denton County.

In the event of malfunction, breakdown, or discovery of any defect after accepting the vessel, LESSEE shall immediately report it to Next Wave Boat Rentals. Continued use of the vessel after any such discovery shall be entirely at the LESSEE’s risk, and LESSEE assumes all liability for injuries or damages to persons or property that result from continued use.

Acknowledgment and Voluntary Consent

The undersigned states they have had sufficient time to review this Waiver and Liability Release and to ask questions regarding its contents. They understand that employees of Next Wave Boat Rentals are not attorneys and cannot provide legal interpretation or advice.

The undersigned confirms they have carefully read the contents of this agreement, sign it of their own free will, and understand that it constitutes a full waiver of legal rights, including the right to bring any claim or lawsuit for injuries or damages caused by the negligence of Next Wave Boat Rentals.

Furthermore, LESSEE acknowledges that:

  • They may have rented from another provider, but knowingly chose to rent from Next Wave Boat Rentals, where signing this waiver is required;
  • This waiver shall override any conflicting language in other rental agreements;
  • They are also signing on behalf of any minor children or guests in their care;
  • They are responsible for disclosing all operators and passengers prior to rental, and failure to do so may result in full personal liability for any injury or damage resulting from undisclosed or unauthorized users.

FORCE MAJEURE

Next Wave Boat Rentals will not be held responsible for failing to perform any obligations or duties under this Agreement and/or losses endured by the LESSEE if the failure or delay is caused by any event or situation beyond the reasonable control of Next Wave Boat Rentals or a “Force Majeure” event including but limited to natural disasters (Acts of God), acts of terrorism or civil unrest, wars or armed conflicts, government actions, labor disputes, epidemics or pandemics, utility or transportation disruptions, and/or any other unforeseeable events outside the control of Next Wave Boat Rentals.

COVENANT NOT TO SUE

As part of the consideration for using the chartered or rented equipment, I promise not to sue or make a claim against TDSKWC LLC for any damage or loss suffered as a result of my participation in the rental activities. It is the intent of this rental agreement to fully and completely release TDSKWC LLC, Next Wave Boats, Next Wave Boat Rentals, and  all employees, agents, representatives, servants, assigns, successors, insurers and subsidiaries of Next Wave Boat Rentals from all claims. 

By submitting a reservation online, in-person, or by phone, you agree to Next Wave Boat Rentals Terms & Conditions, and agree to be bound by them.

GOVERNING LAW & ENFORCEMENT

  • Jurisdiction: Denton County, Texas
  • If any clause is deemed unenforceable, the rest remains valid.
  • Prevailing party in any legal dispute is entitled to attorney’s fees.
  • This agreement is the full understanding between parties.

Should any term or condition of this agreement be held void or unenforceable, then that term shall be deemed severed from this agreement and the enforceability of the remainder shall not be affected and will remain in full force and effect. Time is of the essence as to the performance of all obligations in this agreement. The prevailing party in any litigation between the parties hereto shall be entitled to recover, as a part of its judgment, reasonable attorney’s fees and costs of suit.

While on Texas inland waters (the lake), the LESSEE or operator agrees to abide by all laws governed by both State and Federal law, enforced by local Police, Sheriffs, Game Wardens, or other respective authorities. All laws that apply on land, also apply on inland waters.

Rules & Safety Regulations

LESSEE AGREES THAT LESSEE AND ALL GUESTS ARE REQUIRED TO WEAR A LIFE JACKET/VEST (PFD) AT ALL TIMES WHILE ON THE WATER. THIS INCLUDES WHILE TUBING, OR USING ANY OTHER WATER TOYS. THERE CAN BE NO EXCEPTIONS. By Texas Law, children under 13 years old must wear a U.S. Coast Guard-approved life jacket when on a recreational vessel under 26 feet long. This applies to all vessels underway, including when drifting or not at anchor. IT’S THE LAW!

LESSEE agrees not to use, nor permit the use of the watercraft for any of the following: for any illegal/unlawful purpose, in a careless/negligent manner, while under the influence of liquor, narcotics and/or other illegal/unlawful/controlled substances, or by any other person not a signatory of this agreement, regardless if equally qualified or licensed.

LESSEE acknowledges and accepts responsibility for the safe and proper use and lawful operation of the watercraft, and for the safety and welfare of all in LESSEE’s party, other boaters and all other persons. IT IS AGREED AND UNDERSTOOD BY LESSEE that Next Wave Boats Rentals shall not be held liable for damages or time lost caused by accident, breakdown or malfunction of the vessel.

No Wake Zones and other posted markers. LESSEE agrees to adhere to and abide by all applicable, local, state, and federal laws.

LESSEE agrees that SWIMMING IS AT THEIR OWN RISK.

Do NOT take vessel underneath any bridge or any structure. Failure may cause damage to vessel or passengers.

Vessel must always stay at a minimum of 100 yards from shoreline and any structures except gas dock when arriving/departing rental.

FUEL IS NOT INCLUDED with rental. The vessel will be refueled at the end of the rental period at the LESSEE’s expense at the Sapphire Bay Marina gas dock during final checkout.  

ARRIVING LATE: LESSEE agrees to pay late fees in the event the watercraft is not returned at the specified rental completion time. Late fees will be calculated at the rate of $100 for every 30 minutes past the specified rental completion time.

Bad weather with unsafe conditions such as lightning or high winds will result in a manager making the decision prior to your start time and could result in a cancellation and rental credit issued to use at a future date good for one year or, or if possible, push back to a later time. We will NOT allow boat rental operation in unsafe conditions. Unfavorable weather such as cloudy, cold or chance of sprinkles is not considered a bad weather day and will not result in a Rental Credit or cancellation.

LESSEE agrees to pay $250 rescue fee for any rescue unrelated to vessel manufacturer defect or mechanical failure.

DAMAGE DEPOSIT: A valid credit card shall be retained and will be used to provide full compensation for the LEESEE to return said rental in as good condition as when received. Compensation includes, but is not limited to, reimbursement of articles damaged, missing or broken. I authorize Next Wave Boat Rentals to charge my credit card for these items in such cases. In the alternative, or in addition to the charges to my credit card, Next Wave Boat Rentals, in its sole discretion, may demand that I pay such charges in immediately available funds such as cash or certified check. The amount available on the balance of the credit card shall in no way be considered a limitation on the amount of damages, reimbursements or rental charges owed to Next Wave Boat Rentals. I hereby acknowledge and understand that the vessel is without damages or defects including, but not limited to, dents, scratches, tears, stains and propeller damage. An inspection of the vessel will be conducted by both parties prior to the start of the rental whereby any existing damage will be noted and acknowledged in writing on the inspection form. Upon return of the vessel, a representative of Next Wave Boat Rentals will conduct a final inspection. LESSEE will be held responsible and liable for the total cost of any and all damages to the vessel that were not noted during the inspection form. Next Wave Boat Rentals has up to 48 hours after the rental & prior to being rented again to discover and inform me of damage found.
